Terms of Service

These terms govern your use of Dwell: our iPhone app, our website and the direct-message flows we run on social media. By using them you agree to these terms and to our Privacy Policy.

What Dwell is

Dwell is a media and referral service. We publish short videos and pages about homes for sale and connect you with the real estate agent who represents the listing. Dwell is not a real estate brokerage, agent, lender or appraiser, does not represent you in any transaction, and does not give real estate, legal, tax or financial advice.

Listing information

• Prices, statuses and details come from the listing agent or brokerage or from the home’s public listing, and can change or be wrong. Verify anything that matters with the agent before acting on it.
• Any video made with AI from listing photos is labeled “AI-enhanced photo tour”. Such a video illustrates the photos; it is not a survey of the property.
• Listing photos and details are shown with the permission of their owners, and each home credits its listing agent and brokerage under “Listed by”. You may not copy, scrape, frame or redistribute them beyond sharing a link to a home.

Talking to an agent

When you submit a contact request or answer our questions in a message flow, you ask us to pass your details to the listing agent and you agree that the agent and Dwell may contact you about that home, including by text message where you have opted in. Text program terms are on the SMS program page. Any relationship, negotiation or agreement with an agent is between you and them.

Your account and conduct

• You must be at least 16 years old to use Dwell.
• Give accurate information and keep your sign-in method secure.
• Do not misuse the service: no automated access, reverse engineering, interference, impersonation, or submitting other people’s contact details.
• We may suspend or end access for misuse or to protect the service and its users.
• You can delete your account at any time in the app: Profile, then Delete account.

Comments and community rules

You can comment on homes in the Dwell app. Comments are public. We have zero tolerance for objectionable content and for abusive users. The same rules apply to the message you add to a shared link and to the notes the people in your Shop together group can read. When you comment or write one, do not post:

• Discrimination, or statements about who should or should not live in a home or a neighborhood, for example by race, religion, sex, family status, disability, age or national origin. This is required by the Fair Housing Act.
• Comments about the people of a neighborhood, about crime or safety, or about schools.
• Harassment, insults, hate speech, threats or violent content.
• Sexual content.
• Spam, ads, links or self-promotion.
• Phone numbers, email addresses, home addresses or other personal details of other people.

Every comment, and every message added to a shared link, is checked automatically before others see it: its text is sent to an AI service (Anthropic), which tells us whether it follows these rules and may use it only to do that for us. A message that does not pass is not shown. Our team reviews comments too. We may hold or remove any comment. Accounts that break these rules lose the ability to comment.

To report a comment, use Report on the comment in the app. A reported comment is hidden while we look at it, and we review reports within 24 hours. You can also block the person who wrote it. To report content by email, write to dwell@valid.co.

Intellectual property

Dwell, its design, software and original content belong to us or our licensors. Listing photos and data belong to their owners. Nothing here grants you rights beyond personal, non-commercial use of the service.

Copyright and listing content

Listing photos and details belong to the listing agent, the brokerage or the photographer, who keep their rights. If you own content shown in Dwell and believe we use it without permission, or you are the listing agent and want a home corrected or removed, email dwell@valid.co with a link to the home or its address, the content concerned, your name and contact details, and a statement that you own the content or are authorized to act for the owner. We review every request promptly and remove or correct the content when the request is valid.

Disclaimers and limitation of liability

The service is provided “as is” without warranties of any kind. To the extent allowed by law, Dwell is not liable for indirect, incidental or consequential damages, or for decisions you make based on listing information or agent contact obtained through the service, and our total liability for any claim is limited to one hundred US dollars.

Fair housing

Dwell supports the Fair Housing Act. We do not rank, filter or describe homes by, or make inferences about, race, color, religion, sex, disability, familial status, national origin, or other protected characteristics, and we do not permit users or agents to use the service to do so.

Apple App Store

If you got Dwell from Apple’s App Store: these terms are between you and us, not Apple, and we, not Apple, are solely responsible for the app and its content. You may use the app on Apple-branded devices you own or control, as the Usage Rules in Apple’s Media Services Terms and Conditions allow. We, not Apple, are responsible for maintenance and support. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any; to the extent the law allows, Apple has no other warranty obligation for the app. We, not Apple, handle any claims about the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, consumer protection or privacy claims, and claims that the app infringes someone’s intellectual property. You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on a U.S. Government list of prohibited or restricted parties. You must follow third-party terms that apply when you use the app, such as your wireless data agreement. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes, governing law, contact

We may update these terms; continued use after a change means you accept it. These terms are governed by the laws of the State of California, and disputes are resolved in the state or federal courts located in San Francisco, California. Contact: dwell@valid.co.
